Vietnam: Penalties for violations against the regulations on meteorological and hydrological operation licenses

Recently, the Government of Vietnam has issued Decree 173/2013/ND-CP stipulating penalties for administrative violations against the regulations on the meteorology and hydrology, surveying, and cartography.

Article 5 of Decree 173/2013/ND-CP stipulates penalties for violations against the regulations on meteorological and hydrological operation licenses in Vietnam as follows:

1. A fine ranging from VND 3,000,000 to VND 5,000,000 shall be imposed for one of the following acts:

- Failing to comply with one content specified in the license;

- Changing the headquarters of the licensed organization without notifying the meteorological and hydrological state management agency.

2. A fine ranging from VND 5,000,000 to VND 7,000,000 or revocation of the license for a period ranging from 03 (three) months to 06 (six) months shall be imposed for one of the following acts:

- Failing to comply with two or more contents specified in the license;

- Arbitrarily changing the location of meteorological and hydrological constructions.

3. A fine ranging from VND 7,000,000 to VND 10,000,000 shall be imposed for modifying or erasing the content of the meteorological and hydrological operation license.

4. A fine ranging from VND 10,000,000 to VND 15,000,000 shall be imposed for conducting meteorological and hydrological activities without a license as required by regulations.

In addition, the following remedial measures are stipulated:

- Revoking the meteorological and hydrological operation license for modifying or erasing the content of the license;

- Reverting to the original state for arbitrarily changing the location of meteorological and hydrological constructions.
