Recently, the Government of Vietnam has issued Decree 173/2013/ND-CP stipulating penalties for administrative violations against the regulations on the meteorology and hydrology, surveying, and cartography.
Vietnam: A fine of up to 12 million VND for delay in provision of information on upstream and downstream water levels of a reservoir (Illustrative image)
According to Article 7 of Decree 173/2013/ND-CP, a fine ranging from VND 10,000,000 to VND 12,000,000 is imposed for the delay in the provision of the following information on upstream and downstream water levels of a reservoir to the meteorological and hydrological forecasting agency:
- Information on upstream and downstream water levels of a reservoir;
- Information about the inflow rate, outflow rate, flow rate through the turbine, and total downstream spill flow of the dam;
- Information estimating the potential increase in reservoir water level based on the inflow rate.
In addition, this Decree also stipulates penalties for the provision of reservoir operation information to the meteorological and hydrological forecasting agency in Vietnam as follows:
- A fine ranging from VND 500,000 to VND 1,000,000 for failing to comply with reporting policies on the monitoring, collection of meteorological and hydrological information and data as prescribed.
- A fine ranging from VND 13,000,000 to VND 15,000,000 for failing to provide the following reservoir operation information to the meteorological and hydrological forecasting agency as prescribed:
+ Information on upstream and downstream water levels of a reservoir;
+ Information about the inflow rate, outflow rate, flow rate through the turbine, and total downstream spill flow of the dam;
+ Information estimating the potential increase in reservoir water level based on the inflow rate.
- A fine ranging from VND 15,000,000 to VND 17,000,000 for providing incorrect reservoir operation information to the meteorological and hydrological forecasting agency:
+ Information on upstream and downstream water levels of a reservoir;
+ Information about the inflow rate, outflow rate, flow rate through the turbine, and total downstream spill flow of the dam;
+ Information estimating the potential increase in reservoir water level based on the inflow rate.
- A fine ranging from VND 17,000,000 to VND 20,000,000 for failing to conduct monitoring and collect meteorological and hydrological information and data as prescribed.
