According to Article 3 of Decree 23/2015/ND-CP on issuing copies from master registers, authentication of copies from originals, authentication of signatures, and authentication of contracts and transactions: Copies authenticated from the originals under the provisions of this Decree have the same validity as the originals used for comparison and authentication in transactions, except where otherwise provided by law.
Law on Notarization 2014 and Decree 23/2015/ND-CP as well as prior regulations on notarization and certification (Law on Notarization 2006, Decree No. 79/2007/ND-CP on certification) do not specify the validity period of a notarized or certified copy. Therefore, in principle, a notarized or certified copy is of indefinite validity.
From a practical standpoint, notarized and certified copies can be categorized into two types:
- "Indefinite" copies: These are copies certified from documents such as (transcripts, bachelor degrees, motorcycle driving licenses...) which have indefinite validity, except where the originals have been revoked or annulled.
- "Limited" copies: These are copies certified from documents with a defined validity period such as Identity Cards (15 years), Judicial Record Certificates (6 months), Marital Status Certificates (6 months)... Therefore, the certified copies are only valid for use within the validity period of the originals. However, the evidentiary value of such copies remains as they confirm legal events occurring in the past. For example, at that time, the citizen had the ID number as shown on the copy, and the person was not married to anyone...
For documents that are subject to changes during their usage (such as business registration certificates, investment licenses, household registration books...), the responsible officer has the authority to request the parties to present the originals for verification rather than requiring them to submit new copies.
