Decree 36/2015/ND-CP stipulates the criteria for establishing Provincial, Inter-provincial, and Centrally-run City Customs Departments; the organization, responsibilities, and activities of Customs at all levels, issued on April 17, 2015.

According to Decree 36/2015/ND-CP, the Customs Department is established when the proposed management area meets two of the following three criteria:
- The total value of exports and imports is greater than 30% of the national average total export and import value or the national average total export and import value (excluding the management area of the Customs Department of Ho Chi Minh City and the Customs Department of Hai Phong City) in the year preceding the year of the proposal.
- It has one of the important international land border gates, civil aviation ports, or seaports of the country.
- It includes an Industrial Park or Economic Zone.
In special cases, to meet management requirements, protect national sovereignty, and ensure socio-economic security in areas with long borders, complex terrains, or to facilitate investment and socio-economic development in key regions of the country, the establishment of a Customs Department is considered and decided by the Prime Minister of the Government of Vietnam.
Based on the criteria specified in Clause 1 of this Article, the Minister of Finance reviews and develops a plan to reorganize the Customs Departments to submit to the Prime Minister of the Government of Vietnam for consideration and decision. In the case of establishing a new Customs Department, the proposed management area must meet the conditions specified at Point a, Clause 1 of this Article. The Prime Minister of the Government of Vietnam decides on the establishment and reorganization of the Customs Department.
