The Ministry of Justice issued Circular 01/2016/TT-BTP on February 1, 2016, specifically regulating the storage of books and records regarding judgment enforcement.
Accordingly, the storage of books and dossiers on the execution of civil judgments is regulated by Circular 01 as follows:
- Before books and dossiers on the execution of civil judgments are archived, the civil judgment execution agency must check, arrange, and complete the procedures to ensure they are comprehensive and thorough.
- After the execution of the judgment is complete, the bailiff assigned to organize the execution of the case must check the documents in the dossier; sign and clearly state their full name at the bottom right corner of the statistical table and transfer it to the Examiner for a check, sign, and confirm at the bottom left corner of the statistical table, then report to the Head of the civil judgment execution agency for approval to archive.
- The Head of the civil judgment execution agency will note at the bottom right corner of page 01 of the dossier cover: for archival from the date, month, year; sign and stamp. After that, the dossier is transferred to the archival officer. The transfer of the dossier to the archival officer must be recorded in a memorandum and clearly state the number of dossiers being archived, accompanied by a list of transferred dossiers.
- At the same time, Circular 01 also regulates the storage, preservation, exploitation, and use of archived dossiers on the execution of civil judgments, with the archival duration being implemented according to the law on archival.
- The individual assigned to the archival task of civil judgment execution dossiers must enter the information in the Civil Judgment Execution Dossier Archival Monitoring Book, filling in all columns and sections; arrange the archived dossiers scientifically to ensure convenience for checking, exploitation, usage, and preservation. In case it is necessary to withdraw archived dossiers for inspection, resolution of complaints, denunciations, scientific research, and other requirements, the approval of the Head of the civil judgment execution agency is required.
