The Integrated document of the Law on Handling Administrative Violations is Integrated document No. 20/VBHN-VPQH, consolidating the following documents:
- Law on Handling Administrative Violations 2012, effective from July 1, 2013;
- Law on Customs 2014, effective from January 1, 2015;
- Law on Fisheries 2017, effective from January 1, 2019;
- Amended Law on Handling Administrative Violations 2020, effective from January 1, 2022;
- Law No. 09/2022/QH15 amending and supplementing several articles of the Law on Radio Frequency, effective from July 1, 2023;
- Law on Inspection 2022, effective from July 1, 2023.
2. What are the maximum fines in various sectors in Vietnam?
Specifically, Article 24 of the Integrated document No. 20/VBHN-VPQH stipulates the maximum fines in various sectors as follows:
(1) The maximum fines in various state management sectors for individuals are specified as follows:
- Fines up to VND 30,000,000: marriage and family; gender equality; domestic violence; archiving; beliefs and religions; emulation, commendation; judicial administration; population; environmental sanitation; statistics; foreign affairs;
- Fines up to VND 40,000,000: public order and safety; obstruction of court proceedings; civil judgment enforcement; enterprise and cooperative bankruptcy; electronic transactions; postal services;
- Fines up to VND 50,000,000: fire prevention and fighting; rescue; judicial support; preventive health; HIV/AIDS prevention; culture; sports; tourism; scientific and technological management; technology transfer; child protection and care; social protection and relief; disaster prevention;
- Fines up to VND 75,000,000: cryptography; management and protection of national borders; national defense and security; labor; education; vocational education; road transport; railway transport; inland waterway transport; health insurance; social insurance; unemployment insurance; social evil prevention;
- Fines up to VND 100,000,000: dyke management; medical examination and treatment; cosmetics; pharmaceuticals, medical equipment; livestock; fertilizers; advertising; betting and gaming; management of overseas labor; maritime transport; civil aviation activities; management and protection of transport infrastructure;
- Fines up to VND 150,000,000: price management; exploitation, production, and business of building materials; management of technical infrastructure works; management and development of houses and public offices; bidding; investment;
- Fines up to VND 200,000,000: production and trafficking of prohibited and counterfeit goods; consumer protection;
- Fines up to VND 250,000,000: investigation, planning, exploration, exploitation, and use of water resources; irrigation; intellectual property; journalism;
- Fines up to VND 500,000,000: construction; forestry; land; real estate business;
- Fines up to VND 1,000,000,000: management of sea areas, islands, and continental shelf of the Socialist Republic of Vietnam; management of nuclear and radioactive substances, atomic energy; currency, precious metals, gemstones, banking, credit; oil and gas industry and other mineral activities; environmental protection; fisheries.
(2) The maximum fines in the state management sectors specified in (1) for organizations are double the fines for individuals.
(3) The maximum fines in the sectors of tax; measurement; food safety; product and goods quality; securities; competition are as specified in the corresponding laws.
(4) The maximum fines for new areas not specified in (1) are stipulated by the Government of Vietnam after being approved by the Standing Committee of the National Assembly of Vietnam.
