Responsibilities in Protecting Surveying Infrastructure Works

Organization and individuals are responsible for maintaining and protecting surveying infrastructure works, and promptly notifying the local government or relevant authorities, organizations, or individuals upon discovering that the surveying infrastructure works are damaged, destroyed, or at risk of being damaged or destroyed.

Law on Surveying and Mapping 2018 stipulates the protection of surveying infrastructure works as follows:

- Surveying infrastructure works are established with protection corridors, and land use rights within the protection corridor of the works are implemented in accordance with the provisions of land law.- Within the protection corridor of surveying infrastructure works, when constructing, repairing, or renovating architectural works that affect the surveying infrastructure, the owner of the architectural works, and the land user must report to the competent state authority.- The relocation or demolition of surveying infrastructure works due to the requirements of socio-economic development, national defense, and security must be approved by the managing authority of the surveying infrastructure works. Organizations and individuals requesting relocation or demolition must compensate for any damages according to legal regulations.

The responsibility for protecting surveying infrastructure works belongs to:

- The Ministry of Natural Resources and Environment organizes the protection of surveying infrastructure works as stipulated in points a, c, and d, clause 2, Article 35 of the Law on Surveying and Mapping 2018;- Ministries, ministerial-level agencies, and agencies under the Government of Vietnam organize the protection of specialized surveying infrastructure works under their management;- Provincial People's Committees organize the protection of surveying infrastructure works under their management and the surveying infrastructure works stipulated in point b, clause 2, Article 35 of the Law on Surveying and Mapping 2018; coordinate the protection of other surveying infrastructure works in the locality;- Organizations and individuals organize the protection of surveying infrastructure works under their management.

The Law on Surveying and Mapping 2018 will take effect from January 1, 2019.
