On June 22, 2020, the Ministry of Public Security issued Circular 69/2020/TT-BCA stipulating the inspection of environmental protection work in the People's Public Security Forces in Vietnam.
Responsibilities and Authorities of Members of the Environmental Protection Inspection Team in Vietnam
Article 9 Circular 69/2020/TT-BCA stipulates the responsibilities and authority of the members of the inspection team, the Head of the inspection team, and the Secretary of the inspection team. To be specific:
1. General responsibilities and authority of the members of the inspection team in Vietnam
- Comply with legal provisions, regulations of the Ministry of Public Security on inspection, strictly follow the approved inspection plan and program;
- Study the files and documents provided for the inspection activities;
- Request the inspected subjects to provide information, documents, reports, and explanations related to the inspection content;
- Manage the provided documents according to legal regulations and hand them over when requested by the inspection agency after completing the task;
- During the inspection process, if issues and obstacles are found in the environmental protection work of the inspected subjects beyond their authority to resolve, they must promptly report to and advise the competent authorities to solve and rectify them.
2. Responsibilities and authority of the Head of the inspection team
In addition to the general responsibilities and authority mentioned above, the Head of the inspection team also has the following responsibilities and authority:
- Preside over, manage, and take overall responsibility for the activities of the inspection team;
- Assign tasks to the members of the inspection team;
- Guide the preparation, approval, and signing of the inspection minutes, report the inspection results to the inspection decision maker; guide the preparation of the final inspection dossier.
Additionally, the Deputy Head of the inspection team has the general responsibilities and authority of the inspection team members and of the Head of the inspection team when authorized by the Head of the inspection team.
3. Responsibilities and authority of the Secretary of the inspection team
In addition to the general responsibilities and authority mentioned above, the Secretary of the inspection team also has the following responsibilities and authority:
- Collect and provide information, files, and documents to the members of the inspection team for inspection activities;
- Notify the inspected subjects, the members of the inspection team, and relevant organizations and individuals about the inspection program and plan;
- Summarize the results, prepare the inspection minutes that fully and honestly reflect the inspection content;
- Prepare the inspection result report and inspection conclusion notice;
- Prepare the final inspection dossier;
- Perform other tasks assigned by the Head of the team.
