On September 11, 2018, the Government of Vietnam promulgated Decree 117/2018/ND-CP regulating the confidentiality and provision of customer information by credit institutions and foreign bank branches.
According to Decree 117, the application dossier requesting customer information includes the following documents:
- A written request for customer information issued by an authorized individual. The document must contain a clear signature and ensure the following contents:- Specific legal grounds stipulating the authority to request customer information;- Reason and purpose for requesting customer information, clearly stating the relevance of the customer to the purpose for requesting customer information;- Content, scope of customer information, and time limit for providing customer information;- Method of requesting and providing customer information;- Form of the document providing information (copy, print, soft copy, and other forms as prescribed by law);- Information of the representative receiving customer information in case of a direct request, including the following details: Full name, identity card number or citizen identity card or passport, address, phone number.- Other requirements (if any).- Documents issued by competent authorities related to proving the reason and purpose for requesting customer information (inspection decision, examination decision, audit decision, prosecution decision, judgment, execution decision, prosecution decision, coercion decision, penalty decision or other equivalent documents).
The above documents do not apply to the purpose of collecting information for handling denunciations, crime reports, recommendations, prosecutions; protecting national security, preventing and combating legal violations.
Decree 117/2018/ND-CP is effective from November 01, 2018.
