Recently, the Ministry of Home Affairs issued Circular 09/2012/TT-BNV stipulating the procedures and content of inspections regarding recruitment, use, and management of officials and public employees in Vietnam.
Report on the inspection results of officials and public employees no later than 15 Days from the end of inspection (Illustration)
According to Article 14 of Circular 09/2012/TT-BNV, it is stipulated that after finishing the direct inspection phase at the agency or unit under inspection, the Chief Inspector shall direct the compilation of data, analyze the documents collected by the Inspection Team, and evaluate and comment on the inspection content.
Each member of the Inspection Team shall report in writing to the Chief Inspector on the inspection content according to the tasks assigned. The Chief Inspector shall direct the compilation of reports from the members of the Inspection Team to draft the inspection result report.
The draft inspection result report shall be sent to the members of the Inspection Team for comments. Comments from the Inspection Team members must be in writing. If there are differing opinions on the contents of the draft inspection result report, the Chief Inspector shall review, decide, and take responsibility before the law and the person who issued the inspection decision for their decision.
The Chief Inspector shall sign the inspection result report and send it to the person who issued the inspection decision. The time to prepare the inspection result report for submission to the person who made the inspection decision is no later than 15 days from the end of the inspection in Vietnam.
The content of the inspection result report in Vietnam includes:
- Overview of the agency or unit under inspection;
- Results of inspection and verification of the inspection content;
- Evaluation of strengths, shortcomings, and limitations and the causes of those shortcomings and limitations in complying with legal regulations related to the inspection content;
- Measures taken within authority during the inspection process; recommendations for handling violations of the law; recommendations to levels and competent people to amend, supplement, issue regulations on the recruitment, use, and management of officials and public employees to suit management requirements or abolish illegal regulations detected through inspection (if any);
- Different opinions among the members of the Inspection Team (if any).
