Regulations to Know About Legal Practice Internship Approval

The regulations related to the admission of attorney apprenticeship are addressed by the Ministry of Justice in Circular 19/2013/TT-BTP as follows:

- A person wishing to apprentice at a law practice shall choose and agree with a law practice organization on their apprenticeship.

- The law practice organization admitting the apprentice shall issue a Confirmation Certificate on the admittance of the attorney apprentice as per the form promulgated with [**Circular 19/2013/TT-BTP**](https://lawnet.vn/vb/thong-tu-19-2013-tt-btp-huong-dan-tap-su-hanh-nghe-luat-su-34dbb.html) (Form TP-LS-01) and assign a lawyer who meets the conditions specified in Clause 1, Article 14 of the [**Law on Lawyers**](https://lawnet.vn/vb/luat-luat-su-2006-65-2006-qh11-32b5.html) and Article 12 of this Circular to guide the person wishing to apprentice at a law practice.- The person wishing to be an attorney apprentice and the law practice organization admitting the apprentice may enter into a labor contract according to the provisions of labor laws.

- In case the person wishing to be an attorney apprentice cannot reach an agreement with a law practice organization regarding the acceptance of apprenticeship, they may request the Executive Board of the Bar Association to introduce a law practice organization for apprenticeship. Within ten days from the date of receiving the request, the Executive Board of the Bar Association shall review and assign a law practice organization to admit that person for apprenticeship; in case the law practice organization refuses, it must notify the Bar Association in writing and state the reason.

Additionally, Circular 19/2013/TT-BTP also stipulates that law practice organizations admitting apprentices include:

- Law offices, law companies; branches of law offices, law companies;- Branches of foreign law practice organizations in Vietnam; foreign law companies in Vietnam, branches of foreign law companies in Vietnam.

- Branches of Vietnamese law practice organizations and branches of foreign law companies in Vietnam may admit attorney apprentices when authorized in writing by the head of the law practice organization or the Director of the foreign law company in Vietnam.
