Regulations on the Rates of Fees and Charges for Licensing the Use of Radio Frequencies

On November 14, 2016, the Ministry of Finance issued Circular 265/2016/TT-BTC stipulating the rates, collection policies, remittance, management, and use of fees for licensing the use of radio frequencies and charges for using radio frequencies.

The fee and charge rates for frequency usage permits and the use of radio frequencies are stipulated in Circular 265/2016/TT-BTC as follows:

- Issued together with Circular 265 is the Schedule of fees for issuing frequency usage permits and radio frequency usage fees.- The permit issuance fee is calculated per frequency usage permit.

- The fee for permit renewal is calculated at 20% of the permit issuance fee.- The fee for modifying or supplementing permit content: if not frequency re-assignment, is 20% of permit issuance fee; if frequency re-assignment is required, it is equal to the permit issuance fee.

- Radio frequency usage fees are calculated on a monthly basis. In cases where the total usage time is under one month, it is to be considered as one month. If the total usage time is one month or more, if the odd part is from 15 days or more, it will be rounded up to one month, if the odd part is less than 15 days, the odd part will not be considered.- The permit issuance fees and radio frequency usage fees are collected in Vietnamese Dong.
