The database on temporary custody and detention is constructed to meet the national database technical standards, information technology standards, technical regulations, information security, information safety, and economic-technical norms.
Constructing a database on custody and detention implementation involves performing the following tasks:
- Collecting and accumulating information on the situation and results of custody and detention implementation as well as basic information about detainees and detainees;- Standardizing, entering, and completely updating the collected information into the electronic storage system in a certain structure, suitable for state management needs regarding detainees and detainees.
Clause 3 Article 10 of Decree 121/2017/ND-CP stipulates the forms of collecting and updating information, including:
- Periodic reports, incident reports, thematic reports on the execution of custody and detention and statistical data according to the forms prescribed by the Minister of Public Security and the Minister of National Defense;- Management files of detainees and detainees;- Related databases;- Other forms.
The agencies authorized to collect information on the situation, results of custody and detention implementation, and basic information about detainees and detainees include:
- The Center for Database on Custody and Detention Implementation under the Ministry of Public Security; Provincial-level custody and detention management agencies; District-level custody and detention management agencies; detention centers; custody houses in the People's Public Security;- Custody and detention management agencies under the Ministry of National Defense; Provincial-level Border Guard Command, Military Region Criminal Enforcement Agencies and equivalent, Detention centers under the Ministry of National Defense.
The agencies authorized to collect information on the situation, results of custody and detention implementation, and basic information about detainees and detainees are entitled to request corrections, supplements or to make corrections, supplements themselves in cases of errors, mistakes, or deficiencies.
Decree 121/2017/ND-CP takes effect from January 01, 2018.
