Registration and Licensing for the Operation of Pollution Treatment Technical Systems in Vietnam

This is noteworthy content in Circular 70/2020/TT-BCA regulating the management and use of technical systems for environmental pollution treatment in the People's Public Security Force and coming into effect in Vietnam from August 06, 2020.

Registration and Licensing for the Operation of Pollution Treatment Technical Systems in Vietnam

Circular 70/2020/TT-BCA stipulates that units invested in and constructing technical systems for pollution treatment must complete full registration and licensing according to legal provisions on environmental protection before putting the system into operation. To be specific:

  1. For domestic water using groundwater sources: Register and obtain a permit to exploit and use water resources according to the provisions in Articles 44 and 45 of the Law on Water Resources 2012 and documents detailing and guiding the implementation of this Law.
  2. For wastewater: Register and obtain a permit to discharge wastewater into water sources according to the provisions in Article 37 of the Law on Water Resources 2012 and documents detailing and guiding the implementation of this Law.
  3. For hazardous waste: Register as a hazardous waste source owner and obtain a Register of Hazardous Waste Source Owner according to the provisions in Article 90 of the Law on Environmental Protection 2014 and documents detailing and guiding the implementation of this Law.
  4. For industrial emissions: Register as an industrial emission source owner and obtain an industrial emission discharge permit according to the provisions in Article 64 of the Law on Environmental Protection 2014 and documents detailing and guiding the implementation of this Law.

Additionally, this Circular stipulates the management and use of pollution treatment technical systems in Vietnam:

- The unit head responsible for managing and using the system, based on the number of systems invested in, is responsible for assigning specialized or concurrent staff to manage and operate. The assignment must be documented in a written task assignment and kept in the system management and use records.

- Assigned personnel must be directly trained, instructed, and evaluated by the technology transfer unit or a specialized technical unit to ensure they thoroughly understand the system management and use procedures.

Details can be found in Circular 70/2020/TT-BCA, which comes into effect in Vietnam from August 6, 2020.
