On October 15, 2014, the Ministry of Transport of Vietnam issued Circular 49/2014/TT-BGTVT regarding the inspection of container safety transported through Vietnamese seaports.
Provisions on suspension of container operations in Vietnam under Circular 49/2014/TT-BGTVT (Illustrative image)
Circular 49/2014/TT-BGTVT stipulates that containers are subject to suspension in the following cases: Containers are not affixed with or have improperly affixed Safety Approval Plates; Containers are not inspected or maintained on schedule; Containers are damaged or have the potential to cause safety hazards according to the National Technical Regulations on the inspection and manufacture of containers transported on vehicles in Vietnam. For containers under suspension, the container owner must undertake the following obligations:
- Conduct repairs and rectify defects, restore the safety status of the container at a container repair and maintenance facility, and submit the completion results of the repairs and rectifications to the Regional Maritime Administration before putting the container back into operation;
- In case the container owner takes the container to a foreign seaport for repairs, they must notify the Regional Maritime Administration. The transportation of the container to a foreign seaport for repairs must ensure maritime safety, security, and environmental pollution prevention;
Note: The Regional Maritime Administration issues a notice of suspension of container operations according to the template specified in Appendix I of this Circular.
