(Chinhphu.vn) - Deputy Minister of Public Security Nguyen Duy Ngoc requested related units of the Ministry of Public Security to complete the draft Decree amending and supplementing a number of articles of 19 decrees related to the submission and presentation of household registration books and temporary residence papers.
Deputy Minister of Public Security Nguyen Duy Ngoc: Complete draft decree dossier ensuring constitutionality, legality, and consistency with the legal system
On November 1, 2022, the Ministry of Public Security organized a meeting on the draft decree amending and supplementing several articles of 19 decrees related to the submission and presentation of household registration books, and temporary residence certificates when carrying out administrative procedures and providing public services.
The necessity to amend 19 decrees related to the submission and presentation of household registration books, temporary residence certificates
According to the Ministry of Public Security, on November 13, 2020, the XIV National Assembly passed the Residence Law during its 10th session, which took effect on July 1, 2021.
In particular, Clause 3 Article 38 of the Residence Law stipulates: "From the effective date of this Law, the issued household registration books and temporary residence certificates will still be used and considered valid documents confirming residence according to the provisions of this Law until December 31, 2022."
On September 11, 2022, the Government of Vietnam issued Resolution No. 121/NQ-CP regarding the Government's regular meeting in August 2022, which assigned the Ministry of Public Security to take the lead and coordinate with the Ministry of Justice to propose amendments to documents by creating a decree that amends multiple decrees through an expedited procedure to address issues related to the abolition of household registration books from January 1, 2023; to be completed by December 2022.
Moreover, the national population database is now operational across the board, allowing citizens to extract residence information from the national population database for administrative procedures and public services.
Requiring citizens to present documents such as household registration books or temporary residence certificates, or requiring the documents in the files to be notarized to prove personal information and residence information already available in the specialized databases connected and shared with the national population database, causes waste and inconvenience for citizens when carrying out administrative procedures.
The aforementioned reasons demonstrate that issuing a decree to amend and supplement several articles of 19 decrees related to the submission and presentation of household registration books and temporary residence certificates in administrative procedures to comply with the provisions of the Residence Law is necessary, consistent with the provisions of the Law on Promulgation of Legal Documents, having a legal basis and meeting the current practical requirements and the needs of the coming years.
Complete the draft decree dossier ensuring consistency with the legal system
Concluding the meeting, Deputy Minister Nguyen Duy Ngoc emphasized that the drafting of the aforementioned decree aims to create the most favorable conditions for citizens when performing administrative procedures and participating in civil and economic transactions, effectively implementing the tasks specified in Scheme 06.
To continue perfecting the draft decree, Deputy Minister Nguyen Duy Ngoc requested that, based on the contributions of the attending delegates, the Department of Legal and Administrative Reforms, the Judiciary coordinate with the Department of Administrative Management and Social Order, and other relevant units of the Ministry of Public Security to study, absorb, fully explain, and complete the draft decree dossier ensuring constitutionality, legality, and consistency with the legal system.
