Prohibition on Inserting Devices Storing State Secrets into Computers Connected to the Internet

This is a notable content stipulated in Circular 04/2015/TT-TTCP which regulates the protection of state secrets in the inspection sector, issued by the Government Inspector General of Vietnam on July 09, 2015

Circular 04/2015/TT-TTCP stipulates prohibited acts in the protection of state secrets in the Inspection sector, including:

- Collecting, providing, revealing, losing, appropriating, buying, selling, illegally destroying documents, items containing state secrets.- Transmitting information containing state secrets via telephone, radio, telegram, fax, computer networks, internet, or other communication means without authorization from competent authorities.- Exchanging, providing documents and items containing state secrets to domestic and foreign organizations, individuals, or taking them abroad without authorization from competent authorities.- Photocopying confidential documents; recording audio, video information, images containing state secrets without authorization from competent authorities.- Abusing the protection of state secrets to conceal unlawful acts, infringe upon the legitimate rights and interests of agencies, organizations, individuals.- Using computers or other devices connected to the internet to draft, type, store information, documents, items containing state secrets; inserting devices containing state secrets into computers connected to the internet.

Moreover, the Circular also stipulates the standards for officials and the arrangement of officials handling state secret-related work in the Inspection sector as follows:

- Civil servants directly involved with state secrets in the Inspection sector must have good moral qualities, be vigilant, have a sense of protecting state secrets, high sense of responsibility; have expertise, professional skills, and the capability to complete assigned tasks.

- The heads of state inspection agencies; Heads of departments, bureaus, units under the Government Inspectorate of Vietnam (collectively referred to as heads of units under the Government Inspectorate of Vietnam) are responsible for arranging officials handling state secret-related work in their agencies, units based on a commitment to protect state secrets according to the format in the Appendix issued with this Circular. The commitment document is kept in the personnel records of the agency, unit.
