Principles of Leasing and Subleasing Telecommunications Numbers from November 01, 2015

Telecommunication businesses need to pay attention to the principles of leasing and subleasing telecommunication subscriber numbers as mentioned in Article 25 of Circular 25/2015/TT-BTTTT, specifically:

- When a telecommunication enterprise sells telecommunications services to another telecommunication enterprise, it is permitted to sublease the allocated telecommunication subscriber numbers. A telecommunication enterprise purchasing services from another telecommunication enterprise for resale is allowed to allocate leased telecommunication subscriber numbers to telecommunication subscribers. Leasing or subleasing telecommunication subscriber numbers that are not related to the resale of telecommunications services is prohibited.

- Both the telecommunication enterprise that leases and the one that subleases telecommunication subscriber numbers must have telecommunications licenses permitting the provision of the same type of telecommunications services.

- The duration of leasing or subleasing telecommunication subscriber numbers must not exceed the corresponding validity period of the telecommunications licenses of the leasing and subleasing enterprises.

Additionally, telecommunication enterprises involved in leasing and subleasing telecommunication subscriber numbers are responsible for complying with the planning, management, and usage regulations related to telecommunication number resources; ensuring the lawful rights and interests of involved organizations and individuals.

Moreover, Circular 25 stipulates that the lease and sublease contracts for telecommunication subscriber numbers must be in writing. If a separate contract is not established, the content of leasing and subleasing telecommunication subscriber numbers must be included in the telecommunications service sales contract.

Besides the general legal provisions on contracts, contracts mentioned in Clause 1 of this Article must include at least the following details:

- Telecommunications licenses of the enterprises (number, date of issuance);- Type of subscriber numbers to be leased;- Quantity of subscriber numbers to be leased;- Lease duration;- Lease price;- Exploitation plan for subscriber numbers in the first 03 years;- Rights and responsibilities of the parties in managing, exploiting, and using subscriber numbers.
