Circular 17/2017/TT-BTC guiding the collection, payment, management, and use of maritime fees and charges issued on February 28, 2017. One of the basic contents in this document is the regulation on the preparation, allocation, and assignment of the estimated revenues and expenditures of maritime fees and charges.
To be specific, according to Article 4 of Circular 17/2017/TT-BTC, the preparation, allocation, assignment of maritime fees and charges estimates shall be carried out in accordance with the provisions of the Law on State Budget and the current guiding documents; This Circular provides additional guidance on specific contents as follows:
1. Estimation Preparation
Annually, based on the Directive of the Prime Minister of the Government of Vietnam and the Circular of the Ministry of Finance on guiding the preparation of state budget estimates; the Ministry of Transport shall notify the inspection number to the Vietnam Maritime Administration.
Based on the revenue level of each type of fee and charge, forecast of the ship and goods throughput via seaports, the volume of assigned tasks, and the economic growth forecast of the maritime sector in the area; the Maritime Port Authorities shall prepare estimates of fee and charge revenues; estimate regular expenditures, irregular task expenditures; amount to be paid to the state budget from fees and charges.
Based on the revenue and expenditure estimates of the Maritime Port Authorities, the Vietnam Maritime Administration shall review and compile the estimates of maritime fees and charges to report to the Ministry of Transport for aggregation and submission to the Ministry of Finance as stipulated.
2. Allocation and Assignment of Estimates
Annually, based on the revenue and expenditure estimates assigned by the competent authority; the Vietnam Maritime Administration shall propose the allocation of revenue and expenditure estimates, payment to the state budget of fees and charges for each Maritime Port Authority (ensuring the principle of balancing the fee revenue retained for expenditure between the Maritime Port Authorities), and report to the Ministry of Transport.
The Ministry of Transport and the Vietnam Maritime Administration shall allocate and assign the estimates of maritime fees and charges in accordance with the provisions of the Law on State Budget and the current guiding documents.
3. Adjustment of Estimates
In case the fee revenue fluctuates (increases or decreases) compared to the initial estimate during the year, the Ministry of Transport shall promptly compile and send to the Ministry of Finance for consensus as a basis for the units to implement.
