Ownerless Real Estate Shall Belong to the Ownership of All People

if the owner of the real estate cannot be determined after completing the procedures to identify the owner, the real estate shall belong to the ownership of the people.

Within 07 working days from the date of completion of the procedures to identify the owner according to the provisions of civil law, if the owner of the real estate cannot be identified, the agency that received the information about the unclaimed real estate shall be responsible for preparing 01 dossier to be sent to the Department of Finance and Planning.

The dossier includes:

- Report on the process of identifying the owner of the real estate from the time of discovery: 01 original copy.- List of locations, area, and current status of the real estate: 01 original copy.- Records and documents related to the process of identifying the owner of the real estate (if any): 01 photocopy.

Within 07 working days from the date of receipt of the complete dossier, the Department of Finance and Planning shall be responsible for preparing a submission document with the dossier attached to be sent to the District People's Committee to forward to the Department of Finance for submission to the Chairman of the Provincial People's Committee or the authorized person designated by the Provincial People's Council to decide on the establishment of state ownership of the property.

Within 07 working days from the date of receipt of the complete dossier from the Department of Finance, the Chairman of the Provincial People's Committee or the authorized person designated by the Provincial People's Council shall issue the Decision on the establishment of state ownership of the property.

Decree 29/2018/ND-CP took effect from March 05, 2018.
