The National Assembly of Vietnam passed the Law on Organization of Local Government 2025 on February 19, 2025.

According to Article 27 of the Law on Organization of Local Government 2025 regulating the organizational structure of the People's Council:

- The People's Council consists of the Standing Committee of the People's Council, Committees of the People's Council, Delegation Groups of the People's Council, and members of the People's Council.

- The Standing Committee of the People's Council is the permanent body of the People's Council, carrying out duties and authority as regulated by the Law on Organization of Local Government 2025, tasks assigned by the People's Council, and other related legal regulations; responsible for reporting work before the People's Council. The structure of the Standing Committee of the People's Council and the number of Vice-Chairpersons at each level are regulated as follows:

+ The Standing Committee of the People's Council includes the Chairperson, Vice-Chairpersons, and members who are Heads of the Committees of the People's Council. Members of the Standing Committee cannot concurrently be members of the People's Committee at the same level;

+ The Chairperson of the provincial or district-level People's Council can be a full-time council member. Vice-Chairpersons at all levels are full-time council members.

In cases where the Chairperson of the provincial People's Council is a full-time council member, the provincial People's Council has one Vice-Chairperson; if the Chairperson is a part-time council member, the provincial People's Council has two Vice-Chairpersons.

District and communal People's Councils have one Vice-Chairperson.

- Committees of the People's Council are bodies of the People's Council, tasked with appraising draft resolutions, reports, proposals before submission to the People's Council, supervising, and recommending issues within their fields of responsibility; responsible for reporting work to the People's Council. The number of Committees and their structures at each level are regulated as follows:

+ The provincial People's Council establishes a Legal Committee, an Economic-Budget Committee, and a Cultural-Social Committee.

The central city-level People's Council establishes a Legal Committee, an Economic-Budget Committee, a Cultural-Social Committee, and an Urban Committee.

The district and communal People's Councils establish a Legal Committee and an Economic-Social Committee.

The People's Councils in provinces, districts, district-level towns, cities, and municipalities with a high number of ethnic minorities can establish an Ethnic Committee;

+ Committees of the People's Council consist of a Head, Deputy Heads, and members;

+ The Head of the provincial or district-level People's Council Committee can be a full-time council member. The Head of the communal People's Council Committee is a part-time council member.

The Head of the provincial or district-level People's Council Committee cannot concurrently be the Head of a specialized agency within the People's Committee at the same level;

+ Deputy Heads of the provincial or district-level People's Council Committee are full-time council members. Deputy Heads of the communal People's Council Committee are part-time council members.

If the Head of the provincial People's Council Committee is a full-time council member, the provincial People's Council Committee has one Deputy Head; if the Head is a part-time council member, the provincial People's Council Committee has two Deputy Heads.

Committees of the district and communal People's Councils have one Deputy Head;

+ Members of the Committees of the People's Councils at each level are part-time council members unless otherwise regulated by the National Assembly.

- Members of the People's Council elected at one or several electoral units form a Delegation Group of the People's Council. The number of Delegation Groups is decided by the Standing Committee.

- The term of office for members of the People's Council follows the term of the People's Council. A supplementary elected council member begins duties from the opening of the subsequent session following the supplementary election to the opening of the first session of the next People's Council term.

The term of office for the Standing Committee, Committees of the People's Council follows the term of the People's Council at the same level. When the term of the People's Council ends, the Standing Committee and Committees continue their duties until the newly elected People's Council appoints a new Standing Committee and Committees.

- Standards and conditions for establishing the Ethnic Committee are regulated at point a, clause 3, Article 27 of the Law on Organization of Local Government 2025 and are implemented following the Standing Committee of the National Assembly’s regulations.

Organizational structure of the People's Committee of Vietnam from March 1, 2025

According to Article 37 of the Law on Organization of Local Government 2025 regulating the organizational structure of the People's Committee:

- The People's Committee consists of the Chairperson, Vice-Chairpersons, and members as regulated by the Government of Vietnam.

- Specialized agencies within the People's Committee organized at the provincial and district-level serve as advisory bodies, assisting the People's Committee in state management in local sectors and performing tasks and exercising authority as decentralized and authorized by the People's Committee, the Chairperson, and higher state authorities.

- Officials of the communal People's Committee assist in advising and supporting the People's Committee, Chairperson in local state management, executing tasks and responsibilities as assigned by the People's Committee and Chairperson in accordance with the law.

- The Government of Vietnam regulates the framework for the number of Vice-Chairpersons, members of the People's Committee at each level, the framework for the number of specialized agencies under the provincial and district-level People's Committees; procedures for proposing council member elections, dismissal, removal of People's Committee members ensuring connectivity with the appointment, dismissal procedures of heads of specialized agencies of the People's Committees; procedures for the execution, removal of Chairperson, Vice-Chairpersons, assignment of acting Chairpersons at local government levels.

The Law on Organization of Local Government 2025 takes effect from March 1, 2025, except for clause 3 Article 50 of the Law on Organization of Local Government 2025.

The Law on Organization of Local Government 2015 (amended and supplemented) ceases to be effective from the date the Law on Organization of Local Government 2025 becomes effective, except for the provision specified in clause 3 Article 50 of the Law on Organization of Local Government 2025.
