Notarization Not Completed Within the Prescribed Time Limit Subject to a Fine of Up to 3 Million VND

At point b, Clause 2, Article 15 Decree 82/2020/ND-CP, it is stipulated that a fine ranging from 3,000,000 VND to 7,000,000 VND shall be imposed for the act of "Notarizing not within the prescribed period." In addition, this penalty also applies to the following acts:

- Notarizing outside the office of the notarial practice organization not conformable;- Notarizing not within the prescribed period;- Improperly correcting technical errors in notarial documents;- Harassing, causing difficulties for the person requesting notarization;- Refusing notarization requests without a valid reason;- Not using Vietnamese language or script;- Not participating in the social-professional organization of notaries;- Guiding more than 02 trainees at the same time;- Guiding trainees without meeting the prescribed conditions;- Not fulfilling the obligations of the trainee’s mentor as prescribed;- Notarizing contracts and transactions in cases where there are no notarization request forms;- Notarizing contracts and transactions in cases where documents in the dossier issued by authorities are erased or altered, causing false content;- Refusing to mentor notarial practice trainees without a valid reason.

Additionally, the Decree stipulates fines ranging from 1,000,000 VND to 3,000,000 VND for any of the following acts:

- Not numbering each page of notarial documents that are more than one page;- Notarizing contracts and transactions in cases where the notarization request form does not fully comply with the regulations;- Not carrying a notary card while practicing;- Not fully participating in the annual professional training for notaries as prescribed.
