From November 20, 2017, Decree 110/2017/ND-CP on the organization and operation of inspection agencies in the MOLISA sector; inspectors, sector-specific inspection officials, inspection collaborators in the MOLISA sector... officially takes effect.
The Inspector of the Department of Labor, Invalids, and Social Affairs performs duties and powers stipulated in Article 24 of the Law on Inspection, Article 13 of Decree 86/2011/ND-CP and other tasks such as: Investigating labor accidents and violations of labor safety, and labor hygiene. Participating in guiding the application of technical standards and regulations on working conditions, labor safety, and labor hygiene. Propagating, guiding, inspecting, and auditing agencies and units under the Department of Labor, Invalids, and Social Affairs to comply with legal provisions on inspection, complaint resolution, denunciation, citizen reception, and anti-corruption.
To be specific, in the field of specialized inspection on labor, labor safety, and hygiene, Decree 110/2017/ND-CP clearly stipulates: Implementing measures to prevent dangerous and harmful factors to workers; measures to handle technical incidents causing loss of labor safety and hygiene, labor accidents, occupational diseases; ensuring labor safety and hygiene for specific types of labor; ensuring labor safety and hygiene at production and business establishments; activities of labor safety and hygiene service organizations.
Regarding the duties and power to conduct specialized inspections of the Directorate of Vocational Education and Training, the Department of Overseas Labor Management, and the Department of Labor Safety, the decree stipulates: The Directorate of Vocational Education and Training, the Department of Overseas Labor Management, and the Department of Labor Safety perform the duties and power assigned to the agencies with specialized inspection functions and activities.
Additionally, performing specialized inspection tasks within the state management scope of the Directorate and Departments. Summarizing and reporting inspection results, resolving complaints, denunciations, and anti-corruption within their jurisdiction to the Inspectorate of the Ministry. Participating with the Inspectorate of the Ministry to guide and train specialized inspectors in the fields managed by the Directorate and Departments. Detecting, preventing, and handling or proposing competent state agencies to handle law violations within the scope of state management according to regulations.
Moreover, Article 11 stipulates the duties and power to conduct specialized inspections of the Director-General of the Directorate of Vocational Education and Training, the Director of the Department of Overseas Labor Management, and the Director of the Department of Labor Safety, including: Deciding on specialized inspections and establishing inspection teams to perform inspection tasks according to legal regulations. Organizing monitoring, urging, and inspecting inspected subjects, agencies, organizations, and individuals involved in implementing inspection conclusions; supervising the activities of inspection teams according to legal regulations. Directing and inspecting the implementation of inspection tasks, citizen reception, complaint resolution, denunciation resolution, and anti-corruption within their responsibilities.
Decree 110/2017/ND-CP will replace Decree 39/2013/ND-CP dated April 24, 2013, of the Government of Vietnam on the organization and operation of the Inspectorate in the labor, invalids, and social affairs sector.
