Mistreatment and Verbal Abuse of Elderly Parents May Be Punishable by Up To 5 Years in Prison

Currently, the situation where children, seeing their parents as elderly and weak, verbally abuse, scold, and even physically assault them is becoming increasingly common. From an ethical perspective, these are unfilial children. In terms of the law, these actions are strictly prohibited, and the penalty for such offenses can be up to 5 years of imprisonment.

According to the provisions in Article 51 of Decree 167/2013/ND-CP, children who insult or mistreat their parents will be fined from VND 500,000 to VND 1,000,000 for the act of infringing upon the honor and dignity of family members.

Article 51. Acts infringing upon the honor and dignity of family members


1. A fine ranging from VND 500,000 to VND 1,000,000 shall be imposed for acts of insulting, mistreating, or infringing upon the honor and dignity of family members.

Additionally, if children exhibit other abusive behaviors towards their parents, such as forcing them to go without food or drink, endure cold, dress in rags, not allowing or restricting personal hygiene, or neglecting to care for their parents, they will be fined from VND 1,500,000 to VND 2,000,000 according to the provisions in Article 50 of Decree 167/2013/ND-CP.

Article 50. Acts of maltreatment or abuse of family members


1. A fine ranging from VND 1,500,000 to VND 2,000,000 shall be imposed for any of the following acts:


a) Treating family members badly, such as forcing them to go without food or drink, endure cold, dress in rags, not allowing or limiting personal hygiene;


b) Neglecting to care for family members who are elderly, weak, disabled, pregnant women, or women nursing small children.

Notably, if the acts of insulting, cursing, or abusing parents by children occur frequently, over a long period, and are of a serious nature, they may be subject to criminal prosecution according to Article 185 of the Criminal Code 2015 for the crime of maltreatment or abuse of grandparents, parents, spouses, children, grandchildren, or persons who have cared for them.

Anyone who treats grandparents, parents, spouses, children, grandchildren, or caregivers badly or commits acts of violence infringing upon their physical bodies in any of the following cases shall be subject to warning, non-custodial reform for up to 3 years, or imprisonment from 6 months to 3 years:

- Frequently causing physical, mental pain to the victim;- Having already been administratively sanctioned for such acts but continues to violate.

The imprisonment term will be from 2 years to 5 years if these abusive acts are performed against elderly people, persons under 16 years old, women known to be pregnant, severely disabled persons, persons with extremely severe disabilities, or those suffering from serious diseases.
