Keeping Confidentiality and Providing Customer Information to Other Organizations and Individuals

The Decree specifically regulates the confidentiality of customer information with other organizations and individuals as follows:

Cases of Providing Customer Information

- Credit institutions and foreign bank branches are only allowed to provide customer information to other organizations or individuals under the following circumstances:- Other organizations or individuals who have the right to request customer information from credit institutions and foreign bank branches as specified in the codes, laws, resolutions of the National Assembly.- With the written consent of the customer or in another form through an agreement with the customer.- Credit institutions and foreign bank branches have the responsibility to provide customer information to the customers themselves or their legal representatives.

Regarding the Confidentiality of Customer Information

- The form, time limit, sequence, and procedures for providing customer information of credit institutions and foreign bank branches to other organizations and individuals shall be implemented according to the regulations of the codes, laws, resolutions of the National Assembly and guiding documents.- In cases where the codes, laws, resolutions of the National Assembly, and guiding documents do not stipulate, the sequence and procedures for providing information of credit institutions and foreign bank branches are as follows:- The form of requesting and providing customer information; the time limit for providing customer information; the sequence and procedures for providing customer information shall be implemented according to the regulations in Article 6, Clause 2 of Article 7, Article 8 of Decree 117.- The dossier requesting the provision of customer information shall be implemented according to the internal regulations of the credit institutions and foreign bank branches.- The form of request and provision; time limit; sequence; procedures, and the dossier requesting the provision of insured deposit information of customers to the deposit insurance organization shall be implemented according to the provisions of law.- The form of requesting and providing customer information; the time limit for providing customer information; the sequence, procedures, and dossier requesting the provision of customer information of credit institutions and foreign bank branches to other organizations and individuals shall be implemented according to the agreement with the customer and consistent with the internal regulations of the credit institutions and foreign bank branches.
