The Law on Execution of Criminal Judgments 2010 was promulgated on June 17, 2010. The law stipulates the following issues: principles, procedures, organization, tasks, and powers of competent authorities in executing judgments and decisions on imprisonment, death penalty, etc.
One of the fundamental contents stipulated in this Law is the regulations on handling inmate violations. Article 38 of the Law on Enforcement of Criminal Sentences 2010 provides:
- During the period of serving a prison sentence, inmates violating the regulations, prison rules, or engaging in unlawful activities will be disciplined in one of the following forms:
- Reprimand;- Warning;- Confinement in a disciplinary cell for up to 10 days.
- During the time of confinement in a disciplinary cell, inmates are not allowed to meet with relatives and may be restrained by foot shackles. Foot shackles are not applied to female inmates, juvenile inmates, or elderly inmates.
- The warden of the prison, the superintendent of the detention center, and the head of the district-level criminal sentence enforcement agency decide on disciplining inmates by written form and keep it in the record.
- In case the inmate's violation shows signs of an offense under the investigative jurisdiction of the prison warden or detention center superintendent, the prison warden or detention center superintendent shall issue a decision to prosecute the case and carry out certain investigative activities as prescribed by law; if it is not under their investigative jurisdiction, they must notify the competent investigative agency.
- Inmates who damage, lose, or destroy property at the place of serving the sentence must compensate.
