Implementation of Reports, Explanations, and Provision of Files and Documents in Civil Judgments Execution

This content is stipulated in Circular 02/2016/TT-BTP issued by the Ministry of Justice on February 1, 2016, regarding the procedure for handling complaints, denunciations, proposals, recommendations, and reflections in civil judgment enforcement.

Accordingly, the implementation of the report explanation, provision of dossiers, and materials in Civil Judgment Enforcement (THADS) is stipulated in Circular 02 as follows:

- For the Executors, the time limit for execution is no more than 02 working days from the date of receiving the request;- For the subordinate civil judgment enforcement agencies, the time limit for reporting explanations, providing dossiers, and materials is no more than 05 working days from the date of receiving the document. Concurrently with issuing the request by postal route, the authority resolving the complaint can use phone, fax, or email, etc., to request the civil judgment enforcement agency to implement;- The Head of the Civil Judgment Enforcement Management Agency and the Head of the Civil Judgment Enforcement Agency are required to provide explanation reports and are responsible for the truthfulness, completeness, and accuracy of the reports, dossiers, and materials. The copied dossiers and materials must be numbered and confirmed by the Head of the agency.
