How is Employee Pay Calculated for Days Off Due to a Storm?

The rainstorm situation is becoming complicated. In response to this situation, many workers have taken leave to avoid encountering danger when going out. Therefore, how will the workers' salary be calculated when taking leave in this case?

Currently, many companies have decided to give employees time off on stormy days, and according to Clause 3, Article 98 of the Labor Code 2012, taking time off on stormy days falls under cases of work stoppage. Therefore, the employee's salary is calculated as follows:

3. If the work stoppage is due to power or water issues not caused by the employer or employees, or due to other objective reasons such as natural disasters, fires, dangerous epidemics, enemy sabotage, relocation of the operation site as requested by competent state authorities, or economic reasons, the stoppage pay shall be agreed upon by both parties but shall not be lower than the regional minimum wage stipulated by the Government of Vietnam.

As such, the stoppage pay for employees working under a labor contract who take time off will be agreed upon by both parties and shall not be lower than the regional minimum wage stipulated in Decree 141/2017/ND-CP.

Note, in cases where employees are absent without permission, which are not covered under Clause 3, Article 98 of the Labor Code 2012, they may have their annual leave days deducted or may have such absences counted as unpaid leave.
