How are Goods That Do Not Conform to Standards Handled?

Circular No. 12/2017/TT-BKHCN has been issued by the Ministry of Science and Technology to amend and supplement Circular No. 26/2012/TT-BKHCN regulating the state inspection of the quality of goods circulating in the market.

To be specific, when goods do not conform to the applicable standards, standard certification, or corresponding technical regulations, the following actions shall be taken:

- Within 24 hours, the inspection team must report to the inspection authority on the test results of the sample.- Within 2 working days from the receipt of the test result slip, the inspection authority must issue a notice to temporarily suspend the circulation of goods;- The seller is required to provide relevant information regarding the same type of goods for remediation, handling, and repair;- The inspection authority handles it according to its jurisdiction and transfers the file, recommending the competent authority or the competent state agency for handling;- After receiving the notice on the violation handling results, the goods must be unsealed within 3 working days to remedy the violations. Once remedied, the inspected facility reports to the inspection authority to conduct re-inspection and retesting of the failed indicators. If the re-inspection meets the requirements, the inspection authority issues a notice allowing the goods to continue circulating in the market.
