Handling Complaints from the Accused

The Ministry of Justice issued Circular 02/2016/TT-BTP on February 1, 2016, specifying regulations regarding the handling of petitions from the accused.

Circular 02 stipulates that within 10 days from the date of receiving the conclusion on the denunciation content, if the accused does not agree, they have the right to submit a written petition to the direct superior of the person who resolved the denunciation, which will be handled as follows:

- In case the resolution on denunciation complies with the law, the direct superior of the person who resolved the denunciation shall issue a written response, requiring the accused to seriously implement the conclusion on the denunciation content.- In case new circumstances are discovered or there are indications of legal violations by the person who resolved the denunciation, re-resolution or directive resolution shall be carried out. The procedures for re-resolution of denunciations shall be implemented in accordance with the law.
