Guidance on Procedures for Preparing and Approving the List of Housing Assistance for People with Meritorious Services

The Ministry of Construction has recently issued Circular 09/2013/TT-BXD guiding the implementation of Decision 22/2013/QD-TTg dated April 26, 2013, by the Prime Minister of the Government of Vietnam on housing support for people with meritorious services to the revolution.

Circular 09/2013/TT-BXD stipulates the establishment and approval of the list for housing support for people with meritorious services to the revolution to be carried out according to the following procedures:

Step 1: Based on Decision 22/2013/QD-TTg and this Circular, hamlets, villages, residential clusters, wards, communes, etc. (collectively referred to as hamlets) shall disseminate the policy on housing support for people with meritorious services to the revolution according to Decision 22/2013/QD-TTg to all relevant individuals in the area. The head of the hamlet guides eligible individuals to apply for housing support (using the form prescribed in Appendix I issued with this Circular), compiles the applications and the list, and sends them to the People’s Committee of the respective commune, ward, or commune-level town.

Step 2: The Commune-level People’s Committee (PC) establishes a Steering Committee for implementing housing support for people with meritorious services to the revolution at the communal level, which includes representatives from the local government, Vietnam Fatherland Front, and Veterans Association, to inspect the housing condition of each applicant. After inspection, the Commune-level PC prepares a list of beneficiaries in the area (using the form prescribed in Appendix II issued with this Circular) and submits it to the District-level People’s Committee.

Step 3: Based on the report from the Commune-level PC, the District-level PC directs the Department of Labor, War Invalids, and Social Affairs, along with related departments, to review, inspect, and compare with the managed list of meritorious individuals, consolidate and approve the list of meritorious beneficiaries to be supported in the district (using the form prescribed in Appendix III issued with this Circular), and report to the Provincial-level PC or Centrally-administered City.

Step 4: Based on the report from the District-level PC, the Provincial-level PC assigns the Department of Construction as the standing body to cooperate with the Department of Finance and the Department of Labor, War Invalids, and Social Affairs to inspect, compare with the regulations, develop and submit the scheme for housing support to meritorious individuals for approval by the Provincial-level PC. The scheme specifies the number of beneficiaries, the levels of support, the responsibilities of involved agencies in implementation, and estimated funding from various sources.

The scheme for housing support for meritorious individuals in the province should clearly distinguish the number and support levels for 2013 and any numbers to be implemented after 2013 (if any).

If the list of beneficiaries supported according to the scheme is less than the number reported by the Provincial-level PC to the Supervision Delegation of the National Assembly Standing Committee in 2012, the capital will be allocated to complete the support in 2013. If the list is greater than the reported number, support will only be provided in 2013 for the quantity reported to the Supervision Delegation of the National Assembly Standing Committee, with the remainder implemented after 2013. The support for 2013 shall be prioritized as follows:

- Households of meritorious individuals whose houses are at risk of collapse, unsafe for use;- Households with elderly meritorious individuals;- Households with meritorious individuals who are ethnic minorities;- Households with meritorious individuals facing difficult circumstances;- Households with meritorious individuals in areas frequently affected by natural disasters.

Step 5: After the provincial-level scheme for housing support is approved, the Provincial-level PC sends the scheme and report (using the form prescribed in Appendix IV issued with this Circular) to the Ministry of Construction, Ministry of Planning and Investment, and Ministry of Finance for consolidation and reporting to the Prime Minister for consideration and decision on funding allocation from the central budget.
