Guidance on Birth Registration for Laotian Migrants to Vietnam

Circular 03/2015/TT-BTP stipulates the conditions, order, and procedures for acquiring Vietnamese nationality, birth registration, and marriage registration for free migrants in the districts of Vietnam adjacent to Laos, issued by the Minister of Justice on April 1, 2015.

Circular 03/2015/TT-BTP stipulates that Laotian migrants in districts of Vietnam who wish to register a birth must go to the People's Committee of the commune in the border district where the person requesting the birth registration resides. The dossier and procedures are as follows:

The birth registration dossier includes:

- Birth registration application form (according to the form issued with this Circular)- Birth certificate (according to the specified form); if there is no Birth certificate, a written pledge about the birth must be submitted.

Procedures:

- Within 1 working day from the time of receiving the complete dossier as prescribed in Clause 2 of this Article, the civil status officer examines and verifies the dossier, cross-references it with the list approved by the Head of the Vietnamese border delegation, and if the information is complete and valid, records the birth details into the Birth Registration Book, the main Birth Certificate, reports to the Chairman of the commune-level People’s Committee to sign, and issues the main Birth Certificate to the person applying for birth registration.

- In case of birth registration for a child born out of wedlock, if the father is not identified, the father's section in the Birth Registration Book and Birth Certificate is left blank. If, at the time of birth registration, someone claims the child, the commune-level People’s Committee resolves both the recognition and the birth registration.

- In case of birth registration for a child of a Vietnamese citizen and a Laotian citizen, the nationality section in the child’s Birth Certificate is recorded as per the written agreement between the parents; if the parents cannot agree on the child's nationality, it is recorded as Vietnamese nationality.

- In case the person being registered for birth is not a child, their nationality is determined based on the information about nationality in the list approved by the Head of the Vietnamese border delegation.

- For those who have been granted Vietnamese nationality according to Article 5 of this Circular, if they request, they are also registered for birth according to this Article, and their Vietnamese nationality is recorded in the Birth Registration Book and the Birth Certificate.
