Goods Remaining at Customs Will Become Public Property

Decree 29/2018/ND-CP was issued by the Government of Vietnam on March 5, 2018, replacing Decree 29/2014/ND-CP, stipulating the order and procedures for the establishment of state ownership of assets and the handling of assets under state ownership.

Goods abandoned at the Customs authority without a claimant after completing the procedures for determining ownership will be under public ownership.

Within 07 working days from the date of completing the procedures for determining ownership without any claimant, the Customs authority where the abandoned goods are located is responsible for preparing one dossier to submit to the Director of the directly managing Customs Department to decide on the establishment of public ownership.

The dossier should include:

- Proposal for the establishment of public ownership over the assets: 01 original copy.- List of types, quantities, weights, conditions of the assets: 01 original copy.- Documents and materials relating to the notice process about the assets and other relevant documents/materials (if any): 01 photocopy.- Written notice of abandonment of goods or proof documents (if any): 01 photocopy.

Within 07 working days from the date of receiving the complete dossier, the Director of the Customs Department shall issue a Decision on the establishment of public ownership over the assets.

Decree 29/2018/ND-CP effective from March 5, 2018.
