General Provisions on Commendation in State Agencies from January 01, 2020

Recently, Circular 12/2019/TT-BNV was issued by the Ministry of Home Affairs, providing detailed regulations for the implementation of several articles of Decree 91/2017/ND-CP dated July 31, 2017, by the Government of Vietnam, which specifies the implementation of certain provisions of the Law on Emulation and Commendation.

According to Circular 12/2019/TT-BNV, it is stipulated that the evaluation, recognition of achievements, and proposal for higher-level commendation for forms of national-level rewards are carried out and held accountable by the head of the ministry, department, sector, or province in accordance with the law. For forms of commendation under the jurisdiction of the ministry, department, sector, or province, the evaluation and recognition of exceptional accomplishment levels and the impact scope of achievements are as regulated by the ministry, department, sector, or province.

Some points to note regarding commendation as regulated in Circular 12/2019/TT-BNV are as follows:

- The head of the ministry, department, sector, or province has the authority to commend or propose higher-level commendation, and is responsible for publicly announcing collectives and individuals proposed for commendation with Medals, State honorary titles, "Ho Chi Minh Prize", "State Prize", "National Emulation Fighter" title through information channels under their management: electronic portals, magazines, sectoral newspapers, local newspapers before the Emulation - Commendation Council of the ministry, department, sector, province convenes to evaluate the commendation. Opinions from the public, information on media and the results of information processing (including complaint and denunciation letters, if any) must be reported to the Emulation - Commendation Council of the ministry, department, sector, or province before deciding on commendation or proposing higher-level commendation.- For commendation based on merits and achievements: The achievement report of the collective or individual proposed for commendation is considered up to 6 months before the ministry, department, sector, or province submits to the Prime Minister the Government of Vietnam. Beyond this period, the Central Emulation - Commendation Board will not accept the commendation submission.- The ministry, department, sector, or province submits commendation documents to the Prime Minister the Government of Vietnam in paper form and simultaneously sends electronic documents through the software "Electronic Commendation Dossier Management System of the Emulation - Commendation Sector". Commendation dossiers are only accepted when the Central Emulation - Commendation Board receives both paper and electronic documents according to confirmations.- Only use the results of commendation based on merits and achievements as a basis for commendation or proposing higher-level commendation. Results of periodic (thematic) commendation are recorded and prioritized during commendation evaluation or proposal for higher-level commendation.- The time for the subsequent commendation proposal is calculated from the time achievements acknowledged in the previous commendation decision are recorded. For commendation decisions without a recorded timeframe, the subsequent commendation proposal time is calculated from the issuance date of the previous commendation decision.- When commending collectives with a Communist Party organization, mass organization, the Communist Party organization, and mass organization must be rated "Excellent completion of tasks".- The time for reviewing emulation titles and forms of commendation for collectives and individuals in the education sector such as: Departments of Education and Training of provinces and centrally-run cities, Divisions of Education and Training of districts, district-level towns, cities under the province, centrally-run cities are reviewed after the end of the school year.- ...
