General Provisions on Commendation in State Agencies

On October 27, 2017, the Ministry of Home Affairs issued Circular 08/2017/TT-BNV to provide general regulations on commendation.

To be specific, Circular 08 prescribes:

- For forms of State-level commendations, the evaluation, recognition of achievements, and recommendation for commendation by higher authorities are carried out by the Head of ministries, departments, sectors, and localities and are responsible before the law.

- For forms of commendations within the authority of ministries, departments, sectors, localities, agencies, organizations, or units under or affiliated with these entities, the evaluation, recognition of outstanding task performance, and the extent of impact of achievements are decided by the Head and are responsible before the law.

According to the Circular:

- The Emulation and Commendation Council of ministries, departments, sectors, and localities is responsible for assisting the Head in evaluating the achievements of collectives and individuals that have a national impact, an impact within the ministry, department, sector, locality, or within the field of management authority;

- The standing body of the Council is responsible for advising the Council’s Chairman in organizing Council meetings. The Council meets when at least two-thirds of the members attend. The Chairman of the Council presides over the meetings or authorizes a Vice-Chairman to preside. The Chairman of the Council votes like other members. The standing body of the Council solicits written opinions from absent members, compiles, and reports to the Chairman of the Council; completes the meeting minutes of the Council and the commendation proposal dossier as prescribed;

The Head of the agency, organization, or unit with authority to commend or recommend commendations to higher authorities is responsible for publicly disclosing the collectives and individuals proposed for commendations such as Orders, State honorary titles, Ho Chi Minh Prize, State Prize, and the title "National Emulation Soldier" on the information media under their management.

Public opinion must be gathered through the information media, and the results of handling information (including complaints and denunciations, if any) must be reported to the Council before deciding on the commendation or recommending commendation to higher authorities.

- The form and level of commendations must match the achievements attained. Special attention should be paid to commending individuals and collectives that have improved significantly from a weak state to become role models in emulation movements; ethnic minorities, and individuals with many innovations in labor, study, and work. Previous commendation achievements should not be accumulated to propose an increase in the level of commendation in the subsequent time.

- Achievement reports of collectives and individuals proposed for commendation must conform to the form and level of commendation as prescribed. The content of the achievement reports follows the templates (from No. 01 to No. 09) in the Annex attached to Decree 91/2017/ND-CP.

- For commendations based on meritorious service and achievements achieved (excluding extraordinary commendations and periodic commendations): The achievement reports of collectives and individuals proposed for commendation should be up to date to the time the ministry, department, sector, locality submits to the Prime Minister of the Government of Vietnam within 03 months; if this period is exceeded, the ministry, department, sector, locality must supplement the achievements of the collective or individual.

- Ministries, departments, sectors, and localities submit the commendation dossier to the Prime Minister of the Government of Vietnam in both paper and electronic documents via the software "Electronic Commendation Management System of the Emulation-Commendation Sector". The commendation proposal dossier is only accepted when the Central Emulation-Commendation Board receives both the paper and electronic documents.

- Only comprehensive achievement commendation results can be used as a basis for considering commendations or recommending commendations to higher authorities. Achievement commendation results in periodic emulation movements are recognized and prioritized when considering commendations or recommending commendations to higher authorities. It should be noted that commendations or commendation recommendations to higher authorities are not made for collectives or individuals currently under disciplinary review, investigation, inspection, or audit by competent authorities regarding violations or whose complaints, denunciations are being verified and cleared.

- Besides, Circular 08 also stipulates that the timeframe for the next commendation proposal is calculated based on the time the achievements were recorded in the previous commendation decision. For commendation decisions that do not specify the time achievements were recorded, the timeframe for subsequent commendation proposals is calculated based on the issuance date of the previous commendation decision.
