This is the notable content stipulated in Circular 38/2020/TT-BCA on the protection of state secrets in the People's Police.
in Article 13 of Circular 38/2020/TT-BCA stipulates the destruction of documents and materials containing state secrets in the People's Public Security in the following cases:

- When it is unnecessary to keep them and destruction does not harm national or ethnic interests;
- If not destroyed immediately, it will cause harm to national or ethnic interests.
However, the destruction of documents and materials containing state secrets must meet the following requirements:
- Ensure there is no leakage or loss of state secrets;
- The destruction process must alter the shape, function, and effect of the documents and materials containing state secrets and completely eliminate the state secret information;
- Documents and materials containing state secrets, after being destroyed, should be unrecoverable in shape, function, effect, and content.
Regarding the authority to destroy documents and materials containing state secrets, the regulations are as follows:
- Persons authorized as specified in Clauses 1 and 2, Article 4 of Circular 38/2020/TT-BCA have the authority to decide the destruction of documents and materials containing state secrets;
- Officials and soldiers managing documents and materials containing state secrets have the right to decide on destruction in case "If not destroyed immediately, it will cause harm to national or ethnic interests" and must immediately report in writing about the destruction to the authorized person.
