Forms of Requesting and Providing Customer Information

Decree 117/2018/ND-CP was promulgated on September 11, 2018. One of the basic contents stipulated in this Decree is the form of requesting and providing customer information.

To be specific, according to the provisions of Article 6 of Decree 117/2018/ND-CP, the forms of requesting and providing customer information are as follows:

- Indirect form: the request for and provision of customer information is carried out through postal service providers or via electronic means, telecommunication networks, and computer networks.

Requests for and provision of customer information via electronic means, telecommunication networks, and computer networks must comply with the provisions of the law on electronic transactions, the guidelines of credit institutions, foreign bank branches, and be consistent with the technical conditions of the parties involved.

- Direct form: the request for and provision of customer information is carried out at the premises of credit institutions, foreign bank branches, and through the representatives of the parties.

The delivery and receipt of customer information are as follows:

- For the indirect form through postal service providers: the delivery and receipt of postal items containing customer information must be in a guaranteed manner, recorded in a log, and monitored for the delivery and receipt of the postal items containing customer information between credit institutions, foreign bank branches, and postal service providers.

- For the indirect form through electronic means, telecommunication networks, and computer networks: the transmission, receipt, provision, and storage of customer information must ensure information security and comply with the procedures and procedures prescribed by law on electronic transactions, network information security, and the guidance of credit institutions and foreign bank branches.

- For the direct form: the delivery and receipt of customer information must be documented, stamped, and signed by the authorized person according to the hierarchy of the credit institution, foreign bank branch, and the signature of the representative receiving the customer information.
