Fine up to 100 million for violations on registration of petrol and oil distribution systems in Vietnam

Article 22 of Decree 99/2020/ND-CP stipulates penalties for violations regarding the registration of petrol and oil distribution systemss and the purchase and sale of petrol and oil according to the distribution system as follows:

1. A fine ranging from VND 20,000,000 to VND 40,000,000 shall be imposed for any of the following violations:

- Failing to register the distribution system with the competent state management agency as prescribed;- Fraud in declaring the registration of the distribution system;- Failing to send the information of the petrol and oil distribution systems to the agency or franchisor for registering the distribution system with the competent state management agency as prescribed.

2. A fine double the amount specified for the violations stipulated in points a and b, clause 1 of this Article shall be imposed if the perpetrator is a key trader.

3. A fine ranging from VND 40,000,000 to VND 60,000,000 shall be imposed on general petrol and oil agents, retail petrol and oil agents, franchised petrol and oil traders, and retail petrol and oil stores for buying or selling petrol and oil to entities outside the distribution system, except for direct sale to consumers.

4. A fine ranging from VND 60,000,000 to VND 100,000,000 shall be imposed for any of the following violations:

- petrol and oil distributors buying or selling petrol and oil to entities outside the distribution system, except for buying from key traders, other petrol and oil distributors, and selling directly to consumers;- Key traders selling petrol and oil to entities outside their distribution system, except for selling to other key traders, petrol and oil distributors, direct production units, and consumers directly.
