File on Payment of State Capital Contribution in PPP Project

Accordingly, Circular 88 stipulates that agencies and units assigned to manage the State's capital contribution are responsible for sending the State Treasury where the account is opened prior to or at the same time as the first request for payment of the State's capital contribution in a PPP project. The legal documents of the PPP project form the basis for payment control, including:

- The project contract and any contract appendices related to the payment, if any. Note: only send once;- Summary table of the value of completed work requested for payment according to the project contract prepared by the investor and certified by the agency or unit assigned to manage the State's capital contribution in the PPP project;- Payment request for investment capital by the agency or unit assigned to manage the State's capital contribution in the PPP project;- Payment voucher according to the accounting voucher system of the Ministry of Finance;- Document from the agency or unit assigned to manage the State's capital contribution in the PPP project confirming that the investor has ensured the disbursement ratio of equity as stipulated in the project contract.

Additionally, Circular 88 also stipulates the payment deadline for the State’s capital contribution in the PPP project as follows:

- The annual capital plan allocated for the State's capital contribution in the PPP project only covers the completed work accepted in accordance with the regulations (currently until December 31 of the planning year); the payment deadline for completed work follows the regulations of the public investment law.
