Dossier Submitted to the Competent Authority for Decision on Area Exempt from Irrigation Fees

The one-member Limited Liability Companies operating irrigation works, which are 100% state-owned and belong to the Ministry of Agriculture and Rural Development, and local irrigation units, must submit original documents to the competent authority to determine the exempted irrigation fee area. Specifically, the documents will correspond to each subject and are specified in Article 9 of Circular 41/2013/TT-BTC as follows:

Firstly: For the one-member Limited Liability Companies operating irrigation works, which are 100% state-owned and belong to the Ministry of Agriculture and Rural Development:

- Submission form of the one-member Limited Liability Companies operating irrigation works, which are 100% state-owned, requesting approval of the exempted irrigation fee area;- List of areas of irrigation, drainage, and water supply of the one-member Limited Liability Company, which is 100% state-owned, along with local irrigation units;- Watering, drainage, and water supply contracts of the one-member Limited Liability Company, which is 100% state-owned, with local irrigation units.

Secondly: For the local irrigation units:

- Submission form of the Department of Agriculture and Rural Development requesting approval of the exempted irrigation fee area for each irrigation management unit;- List of areas of irrigation, drainage, and water supply for each water user territory with confirmation from the People's Committee of the district, county, or district-level town;- Watering, drainage, and water supply contracts (or register) of the irrigation management units with the water users (including: People's Committees of communes, wards, commune-level towns, cooperatives, water usage cooperative organizations, experimental station directors, farm directors, or households, individuals), to establish the list.

The list of areas of irrigation, drainage, and water supply attached to the decision of the Ministry of Agriculture and Rural Development, and the People's Committees of provinces or centrally-run cities is the basis for tendering, planning, or placing orders with the irrigation management units; it is the basis for state agencies to supervise the service of irrigation, drainage, water supply by the irrigation management units; it is the basis for estimating the funding to compensate for the exemption of irrigation fees by the irrigation management units.
