On February 21, 2025, the Government of Vietnam issued Decree 23/2025/ND-CP stipulating electronic signatures and trust services.
Pursuant to Article 34 of Decree 23/2025/ND-CP, the dossier for issuance of a public digital signature certificate includes:
- A request for issuance of a public digital signature certificate submitted in either paper or electronic form following the form provided by the public digital signature certification service provider.
- Accompanying documents include:
+ For individuals: personal identification documents such as national ID card, ID card, electronic ID, ID certificate, level 2 electronic identification account, or a valid passport; valid entry visa or documents proving visa exemption (for foreign individuals);
+ For organizations: establishment decision or documents specifying functions, duties, powers, organizational structure, or business registration certificate or investment certificate or business household registration certificate, and identification document of the legal representative of the organization, including national ID card or ID card or ID certificate or level 2 electronic identification account or passport; or the organization's electronic identification account.
- Individuals and organizations may choose to submit a copy from the original register, certified copy, or electronic copy, or submit a copy accompanied by the original for comparison, or use a level 2 electronic identification account in accordance with laws on electronic identification and authentication.
In cases where the original is presented for comparison, the public digital signature certification service provider must certify the copy and is responsible for its accuracy compared to the original. Consular legalization for documents issued by foreign competent authorities shall comply with legal regulations.
Should the documents in the dossier be electronic copies, the public digital signature certification service provider must have solutions and technology to collect, inspect, and compare to ensure the electronic copies are complete, accurate, and correct with the originals as per legal regulations.
- In cases where the individual or legal representative of the organization provides or uses information in the national ID card, ID card, electronic ID, ID certificate, or information in the individual’s level 2 electronic identification account, or organization’s identification account, the public digital signature certification service provider (having written approval for connection with the electronic identification and authentication system in compliance with laws on electronic identification and authentication or having full means to read data from the electronic chip, level 2 electronic identification account data) shall extract data from the electronic chip, individual’s level 2 electronic identification account data, or organization’s identification account; without requiring the individual or legal representative of the organization to submit documents as stipulated in clause 2 Article 34 of Decree 23/2025/ND-CP.
