Mr. Tran Van Trieu, Director of the Legal Consultation Center of the HCMC Labor Union, replied: Law on Public Employees 2010 stipulates that candidates who pass the public employee recruitment exam must undergo a probationary period, except in cases where they have had at least 12 months of experience in a relevant professional field that matches the requirements of the position being applied for. The probation period lasts from 3 to 12 months and must be specified in the employment contract.
Additionally, according to Clause 3, Article 22 of Decree 29/2012/ND-CP, the probationary period is not counted towards the time for salary grade promotion assessment. Therefore, it is conformable that your unit sets the salary grade promotion time starting from March 1, 2021, excluding the 1-year probationary period.
