Recently, the Ministry of National Defense issued Circular 75/2020/TT-BQP stipulating the application of disciplinary measures, procedures, statute of limitations, time limits, and jurisdiction for handling discipline for the militia and self-defense forces, effective August 5, 2020.

Disciplinary  Action  for  Militia  Members  if  They  Harass  the  Public,  Violate  Public  Order,  Circular  75/2020/TT-BQP

Disciplinary actions applied to militia and self-defense forces of Vietnam in cases of harassment of the people or disturbance of public order

According to Article 26 of Circular 75/2020/TT-BQP, the discipline measures, procedures, time limits, and authority for disciplining militia members are regulated as follows for acts of harassing the public:

- If there is an act of demanding, causing trouble, hindering, preventing the normal activities of the public, or infringing on the health, dignity, honor, or property of the public but not to the extent of criminal prosecution, the militia member will be disciplined with a reprimand, warning, or demotion.

- Violations in one of the following cases will be disciplined with dismissal or stripping of the militia title:

- Holding a command position;

- Persuading others to participate;

- Affecting the reputation, honor of the militia.

Additionally, Article 28 of Circular 75/2020/TT-BQP also specifies disciplinary actions for militia members who violate public order, as follows:

- Violating laws on public order causing consequences not serious enough for criminal prosecution will be disciplined with a reprimand or warning.

- Violations in one of the following cases will be disciplined with demotion or dismissal:

- Having been disciplined but not recognized as having improved and continuing to violate;

- Persuading others to participate.
