The Ministry of Natural Resources and Environment issued Circular 04/2017/TT-BTNMT on April 03, 2017, stipulating specific regulations on the development of the construction program for the sectoral norms of natural resources and environment.
To be specific, Circular 04 stipulates that the formulation of the Construction Norm Program shall be implemented as follows:
- No later than June 30th of the last year of the plan period, organizations and individuals must send their proposals for the construction norms to the Unit in charge of advising and summarizing the planning activities of the Ministry and the specialized state management units under the Ministry of Natural Resources and Environment for consideration and summarization.
Note that proposals for construction norms from organizations and individuals must clearly specify: the name of the norm, the necessity of constructing the norm, the leading agency, the coordinating agency, the implementation time, and the implementation plan.
- State management units directly under the Ministry, according to the assigned functions and tasks, are responsible for reviewing, summarizing, providing opinions, and proposing the list of norms within their managed fields to the Unit in charge of advising and summarizing the planning activities of the Ministry for consideration and opinion before submitting it to the Ministry's leadership for review and approval.
- Within 20 days from the date of receiving proposals for construction norms from the units, the Unit in charge of advising and summarizing the planning activities of the Ministry shall lead and cooperate with relevant units to study, consider, and provide opinions on the proposals for construction norms. The content of the review and opinions focuses on the following issues:
- The necessity of constructing norms;- The scope of adjustment, and the objects of application of the norms;- Consistency and feasibility of the contents expected to be constructed;- Time and ability to complete;- Estimated budget for constructing the norms.
Specifically, in cases where proposals for construction norms need to be amended and supplemented, within 20 days after having the opinions of the Unit in charge of advising and summarizing the planning activities of the Ministry, the unit proposing the list of norms is responsible for assimilating, explaining, finalizing the content of the proposed list, and sending it to the Unit in charge of advising and summarizing the planning activities of the Ministry.
