Recently, the Government of Vietnam has issued Decree 95/2020/ND-CP providing guidelines for the implementation of procurement under the CPTPP in Vietnam
Decree 95: Regulations onposting invitation for bid in Vietnam (Illustrative Image)
Decree 95/2020/ND-CP stipulates that the content of publishing invitation for bid also includes the following information:
- Notice on whether the bidding package is within the scope of the CPTPP Agreement;
- Name of the procurement agency;- Address of the procurement agency;
- Name of the bidding package;
- Name of the project, procurement estimate;
- Field of bidder selection;
- Contract execution duration;
- Funding source or method of arranging funds;- Form and method of bidder selection;
- Bid closing time;
- Bid opening time;
- Method of bid submission (submitted electronically or non-electronically);
- Address for receiving bids (received electronically or non-electronically);
- Bid security, form of security;
- Language used in the bidding documents;
- Fee for bid submission if the procurer receives bids online;
- Optional extra purchase (if any).
In addition, this Decree also stipulates that the language used in bidding includes:
- For intra-bloc bidding, the language used in bidding is Vietnamese or Vietnamese and English.
- For international bidding, the language used in bidding is English or Vietnamese and English.
