the Government of Vietnam has just signed and promulgated Decree 80/2020/ND-CP on the management and use of non-refundable aid not classified as official development assistance provided by foreign agencies, organizations, and individuals for Vietnam.
The application dossier for non-refundable grants that are not part of official development assistance provided by foreign agencies, organizations, and individuals to Vietnam shall be compiled into 6 sets, and documents in foreign languages must be accompanied by notarized Vietnamese translations.

Decree 80/2020/ND-CP stipulates that the program, project dossier consists of the following documents:
- Document requesting approval of the program, project;
- Document consenting to provide the grant from the Grant Provider.
- Program, project document;
- Documents proving the legal entity status (not applicable if the Grant Provider is a representative diplomatic agency, government agencies, or local authorities of foreign countries).
+ For foreign non-governmental organizations registered in Vietnam: Copy of the Registration Certificate issued by a competent Vietnamese state agency;
+ For individual grant providers: Certified copy of a valid passport;
+ For other grant providers: Certified copy of valid documents proving the legal status of the organization.
Decree 80 stipulates that the non-project dossier (grant disbursed once, individually in cash, in-kind, goods, experts (including volunteer experts), providing inputs for organizing conferences, seminars, training, research, surveys, training) consists of the following documents:
- Document requesting approval of the non-project;
- Document consenting to provide the grant from the Grant Provider;
- Non-project grant document developed by the grant owner in collaboration with the Grant Provider, including key contents: Purpose, content, list of goods (for in-kind and goods grants), expected outcomes of the grant; implementation period; value of the non-project grant; implementation organization method and coordination mechanism during implementation; report obligations on results after receiving and utilizing the grant;
- Documents proving the legal entity status (not applicable if the Grant Provider is a representative diplomatic agency, government agencies, or local authorities).
+ For foreign non-governmental organizations registered in Vietnam: Copy of the Registration Certificate issued by a competent Vietnamese state agency;
+ For individual grant providers: Certified copy of a valid passport;
+ For other grant providers: Certified copy of valid documents proving the legal status of the organization.
- For non-project grants provided in the form of experts, the grant dossier includes: the documents mentioned in points a, b, c, d of this clause; a brief expert profile with a commitment to the responsibility for provided information of the expert; activity program; work permit and legal documents on the expert's professional activities as per relevant laws.
The dossier for non-project grants involving used goods, equipment, and transport vehicles within the approving authority of the Prime Minister of Vietnam:
- In addition to the requirements stated in clause 2 of this Article, an additional quality inspection certificate issued by a lawful and competent inspecting organization recognized by Vietnam or the host country is required. The inspection certificate must conclude the quality of the goods, equipment, and transport vehicles meeting Vietnamese standards or equivalent standards accepted by Vietnam.
- For non-project grants involving used transport vehicles, additional documents required include: notarized Vietnamese translations of the registration certificate or ownership certificate of the vehicle from the Grant Provider; notarized Vietnamese translations of the inspection certificate from a competent authority of the Grant Provider's country. In the case of temporarily imported re-exported vehicles, an inspection certificate from a competent Vietnamese authority is required.
The program, project document, and non-project grant document shall be prepared according to the templates specified in Annex I, II, III issued with this Decree.
For grant projects involving public investment, construction investment must comply with the laws on the management of public investment and construction investment.
