Cross-border Transport License Application Dossier for Cambodia - Laos - Vietnam

Recently, Circular 63/2013/TT-BGTVT has been officially issued by the Ministry of Transport, providing guidelines for the implementation of certain Articles of the Memorandum of Understanding between the Government of Vietnam and the countries of the Kingdom of Cambodia, the Lao People's Democratic Republic, and the Socialist Republic of Vietnam regarding road transport.

At present, the Cross-Border Transport Permit between Cambodia - Laos - Vietnam (hereinafter referred to as the CLV Transport Permit) issued to commercial vehicles is valid for 01 (one) year and is multiple-entry. The vehicle must be under the lawful use of transport business units using automobiles. The CLV Transport Permit issued for non-commercial vehicles is valid for 60 (sixty) days from the issuance date.

The dossier for issuing the CLV Transport Permit is prepared according to the guidelines of Circular 63/2013/TT-BGTVT as follows:

First: For commercial vehicles:

- Application for CLV Transport Permit for commercial vehicles as specified in Appendix VI of Circular 63;- Transport business license using automobiles or Business registration certificate for transport business units using automobiles that are not subject to the requirement of a transport business license using automobiles (certified copy or copy accompanied by the original for comparison);- Vehicle registration certificate (certified copy or copy accompanied by the original for comparison);- Route operation approval document (for vehicles engaged in fixed-route passenger transport businesses);- In the case where the vehicle is not owned by the transport business unit, additional documentation proving the lawful use of the vehicle by the transport business unit must be presented (certified copy or copy accompanied by the original for comparison).

Second: For non-commercial vehicles:

- Application for the CLV Transport Permit for non-commercial vehicles as specified in Appendix VII of Circular 63;- Vehicle registration certificate (certified copy or copy accompanied by the original for comparison). In cases where the vehicle is not owned by the organization or individual, documentation proving the lawful use of the vehicle by the organization or individual must be provided (certified copy or copy accompanied by the original for comparison);- For enterprises and cooperatives executing projects, contracts, or business activities in Laos or Cambodia, a contract or document proving the entity is executing a project, contract, or business activity in Laos or Cambodia must be included (certified copy).

Thus, when organizations and individuals involved in the road transport of people and goods across the borders between Cambodia, Laos, and Vietnam need to obtain the Cross-Border Transport Permit between Cambodia - Laos - Vietnam, they should refer to the guidelines in Circular 63/2013/TT-BGTVT to prepare the necessary legal documents.
