Conditions to Become a Legitimate Hui Operator

Nowadays, participating in hui (commonly referred to as ho) is entirely appropriate provided that the regulations set forth by the law on this matter are adhered to. Engaging in hui is strictly prohibited if participants exploit this activity to conceal usurious lending, commit fraud, or misappropriate assets. However, if the purpose is different, such as mutual assistance, this activity will be protected by the law. So what are the conditions to become a hui (ho) leader?

According to the provisions of Article 6 of Decree 19/2019/ND-CP on hui, hui, bieu, and phuong, to become a legal hui (hoi) master, one must fully meet the following conditions:

- The hui master must be at least eighteen years old and must not fall into cases of loss of civil act capacity, limited civil act capacity, or having difficulty in perception or behavior control as stipulated in the Civil Code.

- If members organize the hui themselves, the hui master is the person elected by more than half of the total number of members, unless the members have agreed otherwise.

- Other conditions as agreed by the participants in the hui.

Additionally, Article 17 of Decree 19/2019/ND-CP also specifically stipulates the rights of the hui master as follows:

Article 17. Rights of the hui master

1. The hui master in a non-interest hui has the following rights:

a) Collect the hui shares from members;

b) Require members who do not contribute their hui shares to pay the hui shares in case the hui master has paid on behalf of that member;

c) The rights of the hui master in implementing the provisions of Clause 1, Article 7, Article 9, and Article 10 of this Decree;

d) Other rights as agreed upon.

2. The hui master in an interest-bearing hui has the following rights:

a) The rights specified in Clause 1 of this Article;

b) Receive the hui shares in the first opening period and not pay interest to other members if the hui master is simultaneously a member, unless otherwise agreed.

3. The hui master in a commission-earning hui has the following rights:

a) The rights specified in Clause 1 of this Article if the hui is non-interest-bearing or the rights specified in Clause 2 of this Article if the hui is interest-bearing;

b) Earn commission from the members who receive the hui shares.
