Conditions for Mortgaging Future-Formed Housing at Credit Institutions

This is important content to note in Circular 26/2015/TT-NHNN guiding the order and procedures for the mortgage and release of mortgage of assets which are housing construction investment projects and future-formed houses, issued by the State Bank on December 9, 2015.

The investor is entitled to mortgage future-formed housing within the housing construction investment project when fully meeting the conditions listed in Circular 26/2015/TT-NHNN as follows:

- The mortgaged house must have completed the foundation as stipulated by the construction law;- It is not part of the project that the investor has mortgaged according to the provisions of Circular 26;- It is not subject to disputes, complaints, or lawsuits regarding ownership;- It is not confiscated for judgment execution or confiscated to enforce an administrative decision that has taken legal effect by a competent state agency;- It is not subject to a land recovery decision, evacuation notice, or house demolition by a competent state agency;- …
