Circular 70: Cases of transfer of technical systems for environmental pollution treatment in Vietnam

Recently, the Ministry of Public Security issued Circular 70/2020/TT-BCA regulating the management and use of environmental pollution treatment technical systems within the People's Public Security, which comes into effect in Vietnam from August 06, 2020.

Circular 70: Cases of transfer of technical systems for environmental pollution treatment in Vietnam

To be specific, Clause 1 Article 11 of Circular 70/2020/TT-BCA stipulates that the system can be transferred in the following cases:

- Investment has been approved or system has been installed but there is a change in the investment object or location;

- When there is a change in the managing agency, organizational structure, or management hierarchy;

- Other cases as prescribed by the Law on Management and Use of Public Property 2017 and detailed regulatory documents and guidelines for the implementation of this Law.

Additionally, this Circular also stipulates that the system can be liquidated or sold in the following cases:

- The system has expired according to the manufacturer's guidelines and can no longer be used;

- The system has not expired but is damaged beyond repair, or repair is ineffective (estimated repair cost exceeds 30% of the total system investment cost);

- Other cases as prescribed by the Law on Management and Use of Public Property 2017 and detailed regulatory documents and guidelines for the implementation of this Law.

Note:

- The authority, procedures, and processes for the transfer, liquidation, sale, and management, and use of the proceeds from liquidation or sale are implemented following the provisions of the Law on Management and Use of Public Property 2017, detailed regulatory documents, guidelines for the implementation of this Law, and the Ministry of Public Security's regulations on the management and use of public property.

- The system processed by transfer, liquidation, or sale, before and after implementation, the managing and using unit must report in writing to the Medical Department for guidance, monitoring, and management.
